For people who live in states where their Department Of Insurance (DOI) does not provide essential consumer insurance complaint ratio and/or ranking information, FBIC is here to help! FBIC is pleased to publish the following information table located at the bottom of this page indicating which states Departments of Insurance make available this essential complaint ratio and/or ranking information for consumers on their websites. (FYI, in 1996 only 3-4 states made consumer complaint information available to its consumers and citizens. FBIC working with consumers and citizens in each state have been able to increase this number to more than 20 states unfortunately in some or many cases the information is made available in ways that it is either misleading, useless or of no value for consumers use.) This consumer information is essential in helping and making it possible for consumers to assess and make an educated decision and the best choice as to which of the U.S. Insurance Companies are best to buy from (e.g. Good-faith insurers) and which are best not to buy insurance from (e.g. Bad-faith insurers). FBIC Consumer Alert. FBIC finds the complaint ratio information published by state DOIs to be seriously flawed as a state or local consumer indicator for distinguishing between “a Good Faith Insurer” and “a Bad Faith Insurer”, as state DOIs give equal complaint weighting and counts a minor or administrative infraction complaint (i.e. not replying or responding within the amount of time allowed to respond by state law) equally as it does a consumer bad faith insurer complaint (i.e. willingly denying benefit and payment of a legitimate claim). This state DOI misinformation is the same as giving equal weighting and to counting getting a parking ticket as being equal to that of the murder of an innocent human being. FBIC however finds state DOI complaint ratio information helpful for its own use and utilizes the statistical complaint ratio information as made available from the States DOIs as a beginning basis and small part of its own FBIC process in producing its significantly much more accurate and national ranking system. DOI Complaint Ratios or Indexes by Themselves Have Little Or No Validity or Value To The Consumer When Used Alone. FBIC finds DOI Complaint Ratio Information To Be Misleading And Seriously Flawed And For This Reason FBIC Warns Consumers Against Using State DOI Complaint Ratio Information In Selecting A Good Faith Insurer Until This All-Important And Serious Flaw Is Corrected! The flaw very simply is that DOIs in deriving their complaint ratios treat all complaints equally. For example, they treat an administrative complaint i.e. not replying within 30 days the same as a bad faith complaint i.e. willingly denying or not paying a claim. In addition, it is apparent that the state DOIs are not interested in exposing bad faith insurer practices as all they have to do for starters is draw the lines and connect the dots of those repeated insurer offenders.
The Overwhelming Number Of Complaints Each State DOI (Department Of Insurance) Receives And The Deceptive Consumer Complaint Ratio-Ranking Systems That DOIs Publish To Allegedly Protect Consumers And The Insured Public. According To Each State’s Laws, DOIs Are Supposed To Regulate Insurers Operating In Their State, Investigate And Stop Illegal, Fraudulent And Abusive Insurer Bad Faith And Unfair Claims Insurance Practices From Occurring Against Consumers And Insureds In Order To Protect The Insured Public And Consumers. With The Estimated And Overwhelming Number Of Consumer Complaints And Related Inquiries Submitted To DOIs Nationally Reaching Upwards Of More Than 1,000,000 Annually, It Is Difficult To Believe That DOIs Can Be Doing Their Jobs Rather Than Giving The Appearance Of Just Going Through The Motions. In Addition To The Overwhelming Number Of Complaints, FBIC’s Own Research And Information, As Well As Numerous Court Cases To Support Its Findings, Not To Mention Confirmation By Other Media And Countless Published Resources, FBIC Knows That There Are “Serious” Fraudulent Insurer Unfair Claims Settlement Practices And Occurrences Being Perpetrated And Conducted Repeatedly Upon And Against Claimants, Insured Consumers, The Public At Large As Well As Our Own Local, State And Federal Government. With The Staggering Number Of Claimant Complaints Received By DOIs, It Is Incomprehensible That DOIs Allege That They Do Not Find And Connect The Same Serious And Fraudulent Unfair Claims Practices By Major Insurers And Instead Find Only Just Minor Infractions And Administrative Wrongdoings, That Is As Far As They Let The Public Know And As May Be Exposed By DOIs Each Year. The Serious And Fraudulent Unfair Claims Settlement Practices By Major Insurers At The Very Least Should Be Being Uncovered, Exposed And Made Public By DOIs And Not Covered-Up Or Intentionally Overlooked By Many If Not Most Likely All DOIs As FBIC Alleges Is Currently Being Done.
FBIC Suggestion To State DOIs For Them To Correct Potential Deceptions And Communication Shortfalls In Their Complaint Ratio-Ranking Information To Consumers. FBIC Finds That All Complaints Are Not Created Equal. Yes, We Know And Agree That There Are Complaints Regarding Minor And Administrative Infractions Which May Be Worthy Of A DOI $ Fine Against An Insurer. When A Complaint(s) And Complaint Patterns And Practices By Insurers Are Discovered And Found To Be Much More Serious And Indicative Of Insurer Fraud And/Or (Illegal) Bad Faith Insurer Practices, They Should Not Be Equally Weighted And/Or Counted And Treated Equally As That Of Just Another “Single” Or “One” Complaint As They Are Currently Quantified By Those DOIs That Currently Publish Complaint Ratios And Rankings. Categorizing These Complaints Equally Is Deception, Misrepresentation And Obstruction Of Justice. In Addition, Why Do You Not Continue To Follow Claimants Litigations Against Insurers And Indicate Judgments That Are Secured By Plaintiffs Against Insurers When The Insurers Denied The Policyholder’s Claim Prior To Litigation. For Those DOI Agencies That Do Not Publish Complaint Ratios And Rankings On Their Websites For Consumers To Be Able To View And Help Protect Themselves From Unscrupulous Insurers, FBIC Publishes The Table Below (which also indicates which states these are. FBIC Would Like To Know Why Those States Don’t Publish This Information For Their State’s Citizens And By Not Publishing What Information You Are Hiding From The Public? FBIC Believes That These States DOI Agencies Are Intentionally Hiding Important Consumer Complaint Information Against Insurers And In So Doing Are Guilty Of Deception As Well As Obstruction Of Justice As These State DOIs Are Knowingly Protecting Bad Faith Insurers Illegal Claim Practices And Not Protecting Consumers As Is The DOIs Job, Responsibility And Purpose Of The Agency.
